Regulation R638 — Regulations Governing General Hygiene Requirements for Food Premises — is a national South African food safety regulation under the Foodstuffs, Cosmetics and Disinfectants Act 54 of 1972. It applies to virtually every food business in South Africa: restaurants, fast food outlets, bakeries, food manufacturers, caterers, food retailers, food trucks and spaza shops. Compliance is a legal requirement enforced by municipal Environmental Health Practitioners, who can close non-compliant premises. The regulation requires that the Person in Charge of every food premises holds a recognised food safety qualification from an HPCSA and SAATCA-accredited training provider. A Certificate of Acceptability (COA) is issued by your local municipal Environmental Health Division confirming that your food premises meets the minimum requirements of Regulation R638. Without a COA, you are operating an illegal food premises. To obtain a COA, your premises must comply with R638 requirements for layout, equipment, cleaning, food storage, pest control and hygiene. Your Person in Charge must also hold a recognised food safety qualification from an HPCSA and SAATCA-accredited provider such as ASC. An Environmental Health Practitioner inspects your premises and, if satisfied, issues the COA. ASC advises food businesses on preparing for this inspection and provides the accredited R638 training required.
