Welcome to ASC Food Safety Consultants, also referred to in these terms as ASC, we, us or our. These Terms and Conditions govern access to and use of the ASC website and services, including food safety consulting, public health consulting, audits, inspections, virtual consultations, training programmes and document template toolkits.

1. General Information

ASC provides food safety, food hygiene, public health, quality assurance and food safety management system support services to clients requiring practical compliance and implementation assistance.

Services may include:

• Food safety and public health consulting
• Food safety and compliance training
• GMP, HACCP and FSMS support
• On-site and virtual audits and inspections
• Risk assessment and mitigation planning
• Document template toolkits and implementation materials
• Certification and audit-readiness support

All services are subject to availability. ASC reserves the right to revise, suspend or discontinue services, or to decline service requests, where appropriate.

2. Acceptance of Terms

By using the website or any ASC service, you confirm that you are at least 18 years old, or otherwise have the legal capacity to accept these terms in your jurisdiction. If you act on behalf of a company, farm, institution or other organisation, you confirm that you have authority to bind that entity to these terms.

3. Use of Website

You agree to use the ASC website only for lawful purposes and in compliance with applicable legislation and third-party rights.

You must not:

• Post or transmit unlawful, abusive, harmful, defamatory or misleading content

4. Virtual Consultation Services

ASC offers virtual consultation services relating to food safety, food hygiene, public health, FSMS, regulatory compliance and related technical matters. Consultation sessions are advisory in nature.

4.1 Refund Policy

ASC operates a no-refund policy for confirmed virtual consultation bookings. Once payment has been made and booking confirmation has been issued, the booking is treated as final unless otherwise agreed in writing.

4.2 Client Responsibility

Clients are responsible for confirming that:

• The date and time are suitable before payment is made
• The session scope aligns with the support they require
• The required technology and internet access are available
• The duration and scope limitations are understood before the booking proceeds

4.3 Rescheduling

Where possible, ASC may allow rescheduling by mutual agreement. This is not guaranteed and remains subject to consultant availability and operational practicality.

• Requests should ordinarily be submitted at least 48 hours in advance
• Rescheduled sessions should generally occur within 30 days of the original booking
• Additional fees may apply where the revised scope requires extra work or additional time

4.4 Technical Requirements and Limitations

• Clients remain responsible for their own devices, internet stability and software access
• ASC is not liable for client-side technical issues that interrupt participation
• Third-party communication platform interruptions may affect delivery
• If failure arises on ASC’s side, ASC may reschedule the consultation at no additional cost

4.5 Scope and Service Limitations

• ASC may conclude the consultation at the agreed end time
• Additional work may require a separate booking, proposal or fee
• Consultations do not constitute legal advice
• ASC does not make binding representations on behalf of regulators, auditors or certification bodies

5. Document Template Toolkits

5.1 Purchase and Delivery

• Toolkits are sold in digital format
• Payment must be completed before delivery or download release
• Files may be supplied in Word, Excel, PDF or other stated formats
• Delivery timing may vary depending on order processing and confirmation details

5.2 Refund Position

Toolkit purchases are generally non-refundable once digital delivery or download access has occurred, subject to applicable law and any express written exceptions stated by ASC.

5.3 Licensing and Permitted Use

• Toolkits are supplied under a limited, non-exclusive internal-use licence
• Templates may be adapted for the licensed business, entity or facility
• Internal operational use is allowed within the agreed licence scope
• Redistribution, resale, sublicensing or unauthorised transfer is prohibited

5.4 Important Limitations

• Templates are provided for practical implementation support
• They do not guarantee legal compliance, certification or audit success
• Clients remain responsible for implementation, review, customisation and legal suitability
• ASC liability relating to toolkit use is limited as set out in these terms and in the dedicated toolkit terms page

6. Confidentiality and Data Protection

ASC treats client information with appropriate confidentiality and handles personal information in accordance with applicable data protection requirements and our Privacy Policy.

• Confidential client business information will not be shared without authority, unless legally required
• Staff and service delivery processes are expected to preserve confidentiality
• Data may be processed for service delivery, administration, communication and compliance purposes
• Clients may contact ASC regarding privacy or personal information handling matters

7. Intellectual Property Rights

All website content, branding, layouts, templates, methodologies, text, graphics and supporting materials remain the intellectual property of ASC or its relevant licensors unless clearly stated otherwise.

7.1 ASC Intellectual Property

• ASC materials may not be copied, republished, resold or reused without permission except where expressly licensed
• Unauthorised adaptation, extraction or replication of ASC materials is prohibited

7.2 Client Intellectual Property

• Clients retain ownership of their own records, systems and proprietary information
• Clients grant ASC a limited right to use supplied information for agreed service delivery purposes

8. Limitation of Liability

To the maximum extent permitted by law, ASC excludes liability for indirect, incidental, consequential, special or similar losses arising from website use, reliance on information, service delivery interruptions, toolkit use, training outcomes, audit outcomes or certification decisions.

This includes, without limitation, loss of business, revenue, profit, contracts, expected savings, data, reputation or opportunity.

ASC’s total liability for claims arising out of or connected with the services or these terms will, to the extent permitted by law, be limited to the amount paid by the client for the relevant service or product giving rise to the claim.

You agree to indemnify and hold ASC, its officers, consultants, representatives and service providers harmless from third-party claims, costs, losses or liabilities arising from:

• Your use of the website or ASC materials
• Your misuse of services or templates
• Your breach of these Terms and Conditions
• Your infringement of legal rights or third-party rights

10. Professional Liability and Insurance
