Regulation (EC) 852/2004 Article 5, kept in UK law, requires every food business operator to put in place, implement and maintain permanent procedures based on the HACCP principles, keep the documents up to date and retain records for an appropriate period. UK supermarkets typically require own-label suppliers to hold a GFSI-benchmarked certificate such as BRCGS, and the Food Standards Agency's Safer Food Better Business packs set the expectation for caterers and retailers. United States and exporters to it
FSMA's Preventive Controls for Human Food rule, 21 CFR Part 117, requires a written food safety plan prepared or overseen by a preventive controls qualified individual, with records kept for at least two years and electronic records accepted. FDA will not enforce the FSMA 204 Food Traceability Rule before 20 July 2028. From then, businesses handling foods on the Food Traceability List must keep key data elements for each critical tracking event and, when FDA asks during an outbreak or recall, hand over an electronic sortable spreadsheet within 24 hours. What about data protection?
Records are hosted in South Africa under POPIA, with encryption in transit and at rest, role-based access, daily tested backups and full free export on exit. For clients under the UK and EU GDPR, the UAE PDPL or similar laws, your contract includes a data processing agreement and the sub-processor list. Operational food safety records carry little personal data beyond the name of the person who signed them. Staff training and medical fitness records are, and are handled under that agreement.
